Potential Automotive Class Proceeding Under Investigation: Nissan Leaf High-Voltage Battery and Fast-Charging Issues (Main)

Our firm is currently investigating a potential multi-jurisdictional (Canada-wide) class proceeding in British Columbia concerning 2019–2022 Nissan Leaf vehicles and reported issues affecting the vehicles’ high-voltage battery systems and Level 3 (DC) fast-charging capability.

We have received reports from Nissan Leaf owners who indicate that their vehicles are unable to utilize Level 3 fast charging as advertised, including significant reductions in charging speed following dealer visits or manufacturer-implemented updates.

Our investigation focuses on concerns relating to the design and performance of the high-voltage battery, including the alleged formation of excessive lithium deposits on the battery’s anode. Based on available technical information, it is understood that, over time, these deposits may contribute to the development of a byproduct known as the solid electrolyte interphase. This byproduct may compromise the separator between the anode and cathode, potentially leading to internal short-circuiting, accelerated battery degradation, and impaired charging performance.

It is our preliminary understanding that Nissan Canada has proposed a remedy consisting primarily of a software update to the vehicle’s charging module. Based on the information reviewed to date, this approach appears to reduce or throttle the vehicle’s fast-charging capability rather than remedy the underlying condition affecting the battery itself.

While no Notice of Civil Claim has been filed and no class proceeding has been certified, our preliminary assessment is that the proposed software-based remedy may be insufficient to address the alleged defect. We are investigating whether replacement of the affected high-voltage batteries with non-defective units may be required to provide a complete and durable resolution.

This investigation is ongoing and is being conducted to determine whether the legal requirements under British Columbia’s Class Proceedings Act are met, including whether common issues exist and whether a class proceeding would be the preferable procedure.

What remedy is being proposed by Nissan Canada?

Based on reports, Nissan Canada has proposed a software update to the vehicle’s charging module. Our preliminary assessment is that this update may limit fast-charging speed rather than address the underlying battery issue.


Is battery replacement the only solution?

We are currently investigating whether replacement of affected high-voltage batteries with non-defective units may be required to fully resolve the alleged defect. No conclusions have been reached at this stage.
