KENT PHARMACY COVID-19 VACCINATION CLASS ACTION

- Please DO NOT contact the Supreme Court of British Columbia or any of the Defendants, including the various counsel for the Defendants, for any questions, as neither will be able to assist you with any questions or concerns you might have relating to this class action.

Nature of Action
- On November 9, 2021, Dusevic & Garcha filed the within proposed class proceeding which involves allegations that the Defendants in this matter failed to safely administer COVID-19 vaccinations by re-using the same syringe barrel among patients so as to expose the Plaintiff and Class Members to the serious risk of infections and/or bloodborne pathogens, including, but not limited to, Hepatitis B and/or Hepatitis C and/or human immunodeficiency virus (“HIV”).
Settlement
- A proposed Settlement has been reached in this matter, and on November 25, 2025, the Supreme Court of British Columbia certified this Action against the Defendants as a class proceeding for settlement purposes only. The Defendants deny any liability whatsoever, and the Court did not decide who was right.
- The Class was defined and certified as follows:
"All persons resident in British Columbia who attended the Defendant, KENT PHARMACY, located at 424 Columbia Street, New Westminster, British Columbia on August 24, 25 or 26, 2021 and received a COVID-19 vaccination (the “Class Members”), excluding employees, officers, directors, agents of the Defendants, SEELABOYINA, KENT PHARMACY and KARA, and their family members, class counsel, presiding judges, and any person who has commenced an individual proceeding against or delivered a release to the said Defendants concerning the subject of this proceeding, and were contacted by the Fraser Health Authority by letter advising that the syringe barrel was re-used among patients and that they were at risk of contracting hepatitis B, hepatitis C and/or HIV and to take three blood tests over the next three months: at three weeks, six weeks and three month intervals."

- MNP Ltd. was appointed as the Claims Administrator in this matter to oversee the Notice Program and Claims Administration.

Opt Out
- If you are a Class Member and do not wish to participate in the Action, then you must Opt-Out of this Action.
- To validly Opt-Out of the Action, you must submit a signed and completed Opt-Out Form to the Claims Administrator on or before the Opt-Out Deadline, January 8, 2026, at 5:00 PM (PST).
- Opt-Outs must be sent by mail, courier or email to the Claims Administrator on or before the Opt-Out Deadline, January 8, 2026, at 5:00 PM (PST) using the Opt-Out Form (PDF) found on our website.
- Please ensure that you have properly filled out the entire Opt Out Form before submitting it to the Claims Administrator.
Objection
- If you are a Class Member, you can tell the Court that you don't agree with the proposed Settlement or some part of it by filing an objection. In an objection, you can give the Court reasons why you think the Court should not approve the proposed Settlement and the Court will consider your views at the Settlement Approval Hearing.
- To validly Object to the Settlement, you must submit a signed and completed Objection Form to the Claims Administrator on or before the Objection Deadline, January 8, 2026, at 5:00 PM (PST). Objections submitted after this date will not be considered and, as a result, you will be bound by the terms of the Settlement, which includes a release of your claims against the Defendants.
- Objections must be sent by mail, courier or email to the Claims Administrator on or before the Objection Deadline, January 8, 2026, at 5:00 PM (PST) using the Objection Form (PDF) found on our website.
- If you want to speak at the Settlement Approval Hearing, you must indicate that you intend to do so in your Objection Form. You can hire a lawyer to appear on your behalf at your own expense or you may appear yourself. If you do not state your intention to appear in your Objection Form, or you do not submit a signed and completed Objection Form on or before the Objection Deadline, January 8, 2026, at 5:00 PM (PST), you will waive all objections and can be barred from speaking at the Settlement Approval hearing.
Settlement Approval Hearing
- The Settlement Approval Hearing will take place before the Supreme Court of British Columbia on March 27, 2026, at 2:00 PM (PST) at the Vancouver Courthouse, 800 Smithe Street, Vancouver, British Columbia, V6Z 2E1.
- At the Settlement Approval Hearing, the Court will consider whether the proposed Settlement is fair, reasonable, and in the best interests of the Class. If there are objections, the Court will consider them. The Court will listen to Class Members who have asked to speak at the Settlement Approval Hearing. After the Settlement Approval Hearing, the Court will decide whether to approve the proposed Settlement. We do not know how long this decision will take.
- At the Settlement Approval Hearing, the Court will also decide what fee will be awarded to Class Counsel.
Claims Procedure
- If the proposed Settlement is approved, a Notice of Settlement Approval and Claims Procedure will be sent out by the Claims Administrator to the Class Members notifying them of the Settlement and how to make a Claim for compensation under the Settlement. The Notice of Settlement Approval and Claims Procedure along with the Claims Form will also be posted on Class Counsel's, Dusevic & Garcha's, website.
- The Claims Period, the time in which Class Members can submit their claim to receive benefits under this Settlement, will not open until approximately 30 days after the Settlement Approval Hearing has concluded, and such Claims Period will run for a period of 60 days. The date for when the Claims Period starts and finishes will be known after the Settlement Approval Hearing and such dates will be included in the Notice of Settlement Approval and Claims Procedure that will be sent to all Class Members.
- The Claims Period is NOT OPEN AT THIS TIME.
