BMW X1 and X2 Transmission Rollaway Defect Investigation
We are investigating reports of an alleged defect affecting certain BMW X1 and BMW X2 vehicles equipped with a dual-clutch transmission ("DCT").
According to reports reviewed to date, certain affected vehicles may experience delayed acceleration, hesitation from a stop, loss of propulsion, erratic drivetrain response, harsh engagement of power, and unintended vehicle movement, including instances where the vehicle allegedly rolls while stopped or travelling at low speeds.
Potential BMW X1 and X2 Class Action Investigation
Our firm is investigating a potential class proceeding on behalf of owners and lessees of certain:

The investigation concerns allegations that the vehicles' powertrain, dual-clutch transmission, transfer case, and related software and control systems may contain defects that interfere with proper clutch engagement and power delivery.

− Dealers allegedly advising that the condition is "normal" or that the vehicle is operating as designed.
According to reports reviewed to date, the alleged condition may arise from the interaction between the engine, dual-clutch transmission, transfer case, drivetrain control systems, and associated software responsible for throttle response and clutch engagement.
The investigation is reviewing whether the alleged condition may impair vehicle safety, reliability, drivability, value, and utility.
Safety Concerns
Reports reviewed to date indicate that some owners have experienced significant delays between throttle input and vehicle movement. Other reports describe situations in which the vehicle allegedly rolled on inclines despite the driver's expectation that the transmission was engaged.
If true, these conditions may create safety concerns during ordinary driving situations, including:
− Entering intersections;
− Merging into traffic;
− Parking on inclines;
− Stop-and-go traffic; and
− Other low-speed driving maneuvers.
Warranty and Repair Concerns
Reports reviewed to date indicate that some owners have sought repairs for symptoms including delayed acceleration, hesitation, drivetrain abnormalities, and rollaway behavior.
Our firm is reviewing allegations that certain repair attempts, software updates, transmission adjustments, and other service measures may not permanently resolve the underlying condition. Reports further suggest that some consumers have been advised that the vehicles are operating normally despite continuing symptoms.
