Our firm is reviewing reported concerns involving certain Mazda vehicles equipped with Mazda Connected Services relating to allegations that Mazda may not have adequately disclosed that continued access to certain connected vehicle features would require recurring subscription payments following the expiration of a complimentary trial period.
Reports reviewed to date indicate that Mazda marketed various connected vehicle features through its MyMazda application, including remote engine start, remote door lock and unlock, vehicle finder functionality, vehicle status reporting, maintenance notifications, and other app-based convenience features. Reports further indicate that some owners allegedly lost access to certain functionality after the expiration of a trial period unless they subscribed to a paid Connected Services plan.

Mazda Connected Services Subscription Fees and Remote Feature Access

According to reports reviewed to date, Mazda Connected Services was marketed as a platform that allowed owners to remotely interact with, monitor, and manage their vehicles through the MyMazda application. Advertised features reportedly included:
− Remote engine start;
− Remote door lock and unlock;
− Vehicle finder functionality;
− Vehicle health monitoring;
− Maintenance notifications;
− Vehicle status reporting; and
− Other connected convenience services.
Our firm is reviewing allegations that Mazda promoted these features as part of the ownership experience associated with affected vehicles, while allegedly failing to adequately disclose that continued access to certain features would require payment of recurring subscription fees after a complimentary trial period expired.
Reports reviewed to date indicate that some owners allegedly lost access to certain Connected Services functionality after their complimentary service period ended and were required to purchase a subscription to continue using those features.
Our frim is reviewing whether the reported practices may have affected:
− The value of affected vehicles;
− Consumers' purchasing decisions;
− The utility and convenience of vehicle ownership;
− The availability of remote-access features; and
− The cost of vehicle ownership.
Reports reviewed to date further indicate that some consumers allegedly would have paid less for their vehicles, selected a different vehicle, or reconsidered their purchase decision had they known that continued access to certain Connected Services functionality would require recurring subscription payments.
This investigation is ongoing and is being conducted to determine whether the legal requirements under British Columbia's Class Proceedings Act are met, including whether common issues exist and whether a class proceeding would be the preferable procedure.
