Our investigation focuses on concerns relating to the vehicle’s electrical system design and software control, including the operation of the Serial Data Gateway Module and related systems. Based on available technical information, it is understood that certain modules may remain active or draw power even when the vehicle is in an “OFF” state, including during post-shutdown support cycles and periodic battery monitoring events.
In particular, it is our preliminary understanding that a software anomaly and/or communication error within the vehicle’s electronic systems may cause the Serial Data Gateway Module to generate a parasitic electrical draw, resulting in a discharged or dead 12-volt battery.
Technical materials further indicate that the vehicle’s electrical architecture may continue to support 12-volt loads after shutdown and may periodically reactivate to monitor battery state of charge, which, in certain circumstances, may contribute to unintended battery depletion.
It is our understanding that the manufacturer has proposed a remedy consisting primarily of software reprogramming of the Serial Data Gateway Module, along with battery charging or replacement procedures. Based on the information reviewed to date, this approach may not address the underlying design or system-level issues contributing to the alleged parasitic draw.
While no Notice of Civil Claim has been filed and no class proceeding has been certified, our preliminary assessment is that the issues may be systemic in nature and may affect multiple vehicles within the proposed class.
This investigation is ongoing and is being conducted to determine whether the legal requirements under British Columbia’s Class Proceedings Act are met, including whether common issues exist and whether a class proceeding would be the preferable procedure.
