Google Nest Smart Home Voice Control Investigation (Detailed)

We are reviewing potential issues affecting Google Nest smart home devices that are part of Google’s Nest ecosystem, where the voice command and control functionality may degrade over time, fail intermittently, or stop functioning altogether.

If you have experienced issues where your Google Nest device no longer accurately responds to voice commands, fails to recognize commands, or becomes unusable for its core advertised functionality, you may contact us confidentially and free of charge. No lawsuit has been filed, and no class proceeding has been certified.

Potential Consumer Class Proceeding Under Investigation: Google Nest Smart Home Voice Control Defect (Main)

Our firm is currently investigating a potential multi-jurisdictional (Canada-wide) class proceeding in British Columbia, concerning Google’s sale of its Google Nest smart home devices, including:

  • Google Nest Hub
  • Google Nest Hub Max
  • Google Nest Mini
  • Google Nest Audio

These devices are marketed as part of Google’s Nest ecosystem and are promoted as being controlled primarily through voice commands.

We have received reports from consumers indicating that, after a period of normal use, the devices’ voice command and control system allegedly deteriorates or fails entirely, resulting in the devices no longer accurately responding to voice commands or failing to register voice commands at all. As a result, users may be unable to perform basic functions for which the devices were purchased.

The investigation focuses on concerns that the voice command and control system may be defective and that the failure may be systemic or inevitable, rather than the result of user error, or isolated software issues.

It is our preliminary understanding that Google may offer troubleshooting steps, software updates, or device resets as proposed remedies. Based on the information reviewed to date, these measures may not provide a permanent or effective solution and may fail to restore the devices’ core advertised functionality.

While no Notice of Civil Claim has been filed and no class proceeding has been certified, our preliminary assessment is that the reported issues raise concerns as to whether the devices function as advertised over their expected lifespan. We are investigating whether consumers may be entitled to remedies, including repair, replacement, refunds, or other relief.

This investigation is ongoing and is being conducted to determine whether the legal requirements under British Columbia’s Class Proceedings Act are met, including whether common issues exist and whether a class proceeding would be the preferable procedure.

If you purchased or use a Google Nest smart home device and have experienced persistent or complete voice command failures, you may contact us to share your experience. Providing information is confidential, free of charge, and does not obligate you to retain our firm or participate in any legal proceeding.

This page will be updated as our investigation progresses.

Frequently Asked Questions – Google Nest Smart Home Voice Control Investigation

What is the issue being investigated?

We are reviewing reports that certain Google Nest smart home devices experience failures in their voice command and control system, where devices no longer accurately respond to voice commands or fail to register commands altogether, rendering them partially or fully unusable.

Has a class proceeding been filed?

No. At this time, we are conducting a preliminary investigation only. No Notice of Civil Claim has been filed, and no class proceeding has been certified in British Columbia or elsewhere in Canada.

What does “certification” mean?

Certification is a procedural step where the court determines whether a lawsuit may proceed as a class proceeding. Certification does not decide liability or damages; it addresses whether common issues exist and whether a class proceeding is the preferable procedure for resolving those issues.

Which devices are affected?

The investigation concerns Google’s smart home devices sold as part of the Google Nest ecosystem, including Google Nest Hub, Google Nest Hub Max, Google Nest Mini, and Google Nest Audio. The scope of affected devices has not yet been finally determined.

What remedies has Google offered?

Based on reports, Google may offer software updates, troubleshooting steps, or device resets. Our preliminary assessment is that these measures may not permanently resolve the alleged defect or restore the devices’ core voice-control functionality.

Is device replacement the only possible solution?

We are investigating whether repair, replacement, refunds, or other remedies may be appropriate. No conclusions have been reached at this stage.

How can I provide information?

If you purchased or use a Google Nest smart home device and have experienced voice command failures or loss of functionality, you may contact us to share your experience. This is confidential, free of charge, and does not obligate you to participate in any legal proceeding or retain our firm.

Will I automatically be part of a class proceeding if one is certified?

If a class proceeding is certified, individuals who fall within the class definition are typically included automatically unless they choose to opt out, subject to the court’s order.
