Potential Automotive Class Proceeding Under Investigation:
Lexus RX and NX 12-Volt Battery Charging Defect (2022–2026)
Our firm is currently investigating a potential Canada-wide class proceeding, including in British Columbia, concerning certain:
− 2022-2026 Lexus NX
− 2023-2026 Lexus RX
According to reports reviewed to date, certain affected vehicles may contain an alleged defect affecting the charging and maintenance of the 12-volt auxiliary battery. It is alleged that the vehicles may fail to adequately recharge the battery during normal operation and may permit excessive battery discharge while parked.
Reports reviewed to date indicate that the alleged condition may cause the 12-volt battery to lose charge prematurely, resulting in repeated dead batteries, no-start events, and the need for frequent battery replacement.
Our firm is also reviewing reports that some owners have experienced:
− Vehicles that would not start after being parked for relatively short periods of time;
− Repeated battery failures despite battery replacement;
− Battery warning messages and electrical-system malfunctions;
− Roadside assistance calls and jump-starts;
− Vehicle towing;
− Premature battery replacement;
− Loss of use of the vehicle; and
− Extended repair delays.
Reports reviewed to date further suggest that certain owners have been advised to use battery maintainers, battery tenders, jump packs, or charging devices in order to keep their vehicles operational. Other reports indicate that replacement batteries may experience the same issues as the original battery.
Our firm is reviewing whether the reported condition may materially impair vehicle reliability, safety, utility, value, and expected service life.
Our firm is also reviewing reports that, because the 12-volt battery powers numerous vehicle systems and electronic controls, battery failure may affect the operation of vehicle functions necessary to start and operate the vehicle.
This investigation is ongoing and is being conducted to determine whether the legal requirements under British Columbia’s Class Proceedings Act are met, including whether common issues exist and whether a class proceeding would be the preferable procedure.
If you own or lease an affected Lexus RX or Lexus NX vehicle and have experienced battery failures, repeated battery replacement, no-start conditions, towing, roadside assistance events, or related concerns, you may contact us to share your experience. Providing information is confidential, free of charge, and does not obligate you to retain our firm or participate in any legal proceeding.
